Webinar scheduled for members in CalPERS class action lawsuit

CalPERS policy holders that are members of a class action lawsuit should plan to attend an upcoming webinar for information on settlement options in the case.
On July 9, 2020, CalPERS announced it had reached a settlement in the eight-year legal battle involving its Long-Term Care (LTC) Insurance Program. The case, Wedding, et al. v. California Public Employees’ Retirement System, et al., was originally filed in 2013 and generally alleged that the 85 percent premium increase CalPERS announced in February 2013 (and implemented in 2015-2016) was not permitted under the LTC Insurance contracts between CalPERS and class members.
Under the terms of the settlement, class members who are current policy holders will be able to extract themselves from the LTC Program by surrendering their policies in exchange for a full refund of all premiums paid by class members from the policies’ inception through the date the settlement is finally approved by the court. In addition to relief for current policy holders, the settlement also provides compensation for individuals who let their policies lapse, who became deceased, and who are currently on-claim.
The attorneys for this matter are planning a webinar at 11 a.m. Friday, Sept. 10, to present information and answer questions for settlement class members.

Class members have until Sept. 22, 2021 to complete the Award Acknowledgment and Election Form for a Potential Replacement LTC Policy. Class members who want a refund of all premiums paid have until Dec. 13, 2021 to complete the Award Acknowledgment and Election Form.
